1. Who we are
Ahadi.App ("Ahadi", "we", "us") is a digital escrow and trust platform operated for users transacting primarily in Kenyan Shillings (KES) via M-Pesa and other supported payment methods. We hold funds on trust between a Sender and a Receiver until agreed release conditions are met.
2. Your account
- You must be 18 or older and legally able to enter into contracts.
- You are responsible for keeping your password, PIN and OTP codes secret. Ahadi staff will never ask for them.
- You must give us accurate information and update it when it changes.
- We may suspend or close accounts that break these terms or applicable law.
3. How escrow works on Ahadi
Every deal has three moments:
- Fund — the Sender pays; the money is held by Ahadi, not by the Receiver.
- Deliver — the Receiver ships goods, provides the service, or meets the agreed release condition.
- Release — the Sender confirms, the inspection window ends, or a dispute is resolved. Funds are then released to the Receiver's payout method.
Deal terms (amount, currency, release condition, inspection window) are locked once the deal is funded. Neither party can change them unilaterally after that point.
4. Chama deals
A Chama is a group of members contributing to a shared goal on Ahadi. The group's rules — contribution amount, payout order, release approvals — are set inside the app and enforced by us on the group's behalf. Individual members remain responsible for their own contributions and for the accuracy of information they submit.
5. Fees
Ahadi charges a service fee per deal. The exact fee is shown on the checkout page before payment. Third-party costs (e.g. M-Pesa charges) may also apply and are shown where relevant. We may change fees with reasonable notice.
6. Disputes and refunds
If a Sender and Receiver disagree, either party can open a dispute before the inspection window closes. We may pause the deal, request evidence from both sides, and make a good-faith decision to release, refund, or split the funds. Our decision is administrative and doesn't stop either party pursuing legal remedies.
7. Prohibited use
You may not use Ahadi for anything on our Acceptable use list, including illegal goods, fraud, money laundering, or transactions with sanctioned parties. See KYC & sanctions for details.
8. Limits of our role
Ahadi is not a bank, a payments processor of last resort, or a party to the underlying commercial deal between Sender and Receiver. We don't guarantee the quality of goods or services. We escrow the money; you agree the deal.
9. Liability
To the fullest extent allowed by law, Ahadi is not liable for indirect, incidental, or consequential losses. Our aggregate liability for a given deal is capped at the service fees we charged for that deal.
10. Changes
We may update these terms. Material changes will be announced in-app or by email. Continuing to use Ahadi after the effective date means you accept the update.
11. Governing law
These terms are governed by the laws of Kenya. Disputes go to the courts of Kenya unless applicable consumer law says otherwise.
